These are the Terms and Conditions for our Terms of Service. We in this agreement refers to Thebeautymarts Sdn Bhd, the owner and operator of Thebeautymarts.
Order Fulfillment
Orders will be fulfilled within one to two business days, at most - unless otherwise stated in the availability information for the particular item. Please allow for two to two to three business days for delivery, depending on location it is delivered to. As soon as possible, we will email or SMS to you a tracking number for you to track the package.
Effectiveness of Products
We make no structural or functional or therapeutic claims of any kind whatsoever for any of our products sold. We are only resellers of the products, manufactured and distributed by others in Malaysia or overseas. Results given in testimonials are from actual customers who have used our products but are not claimed as typical. Results will vary for every individual, depending on many factors including but not limited to age factor, individual metabolism, initial skin condition, medical history and medical condition, lifestyle and individual biological reaction. Your own experience(s) may vary from those mentioned in the testimonials and advertorials.
For weight loss products and beauty products, we strongly recommend a healthy lifestyle combined with our offered products for an effective outcome. This includes a healthy diet, sufficient exercise and rest.
Medical Condition & Side Effects
If you have a medical condition, allergies or any health situation that might impact your safe use of any cosmetic product or the listed ingredients, natural or synthetic, consult with your licensed physician before using our (or any) cosmetic product. If you develop an allergic reaction when using the purchased product(s), please stop using it immediately and seek medical attention. Unless otherwise stated, products contain fragrances which may not be suitable for sensitive skin. We provide no warranties or shall be liable for any damages or cost incurred due to adverse results from using the said-product. You agree to use the products at your own risk. If this is your first time using this product, you are advised to first try the product in small quantities on a restricted part of your body.
For food items, supplements and medicines, it would be best if you seek advice of your general practitioner (GP) or consultant physician prior to commencing on using this product. For medicines, you MUST obtain professional medical advice and a prescription from your doctor BEFORE commencing usage of any medicines purchased from our store. Products are not intended to diagnose, treat, cure or prevent any disease. The manufacturer and distributor have not disclosed any side-effects from using this product. If you suffer from a side effect from this product, please discontinue use immediately and seek professional medical attention.
Unless otherwise stated, all food items including medicines and supplements may contain or have traces of peanuts, soy products and other products which causes allergy. Please be informed and use all products with caution, especially for first time users.
Warranty
This product is sold as it is, we, Thebeautymarts Sdn Bhd, makes no warranty nor accepts any liability from the usage of this product. In other words, you are to take this product at your risk. Thebeautymarts makes no representation to the claims and description of products here-in. This listing / description of product / advertisement do not substitute professional health care advice.
Please note that all information provided here-in are based on write-ups, brochures and websites by the product manfuacturers or their appointed agents. This includes reproduction of marketing material by the manufacturers or brand owners, with and without editing by Thebeautymarts to best reflect the advertise product(s). We acknowledge the intellectual property of others and the including the brand owners of the respective products.
Order Cancellation or Alterations
No order cancellations or alternations are allowed. This is because once posted, we are not able to recall the package.As such, we do not offer any offer cancellation or alterations of confirmed purchases.
Free Gifts & Promotional Items
*While stock last. If we are not able to delivery the advertised free gift (if any is indeed advertised), we reserve the right to replace the free gift, solely at our descretion, with another item at the same value. We strive to update our advertisements to accurately reflect our inventory levels, but some circumstances are beyond our control.
Product Returns
Thebeautymarts offers refunds and returns of our product, unless it is specifically stated that returns are not allowed. Purchaser / The Customer shall pay for the postage to return such items to Thebeautymarts. Refunds are only made to items that are unopened and undamaged. All returns must be posted back to Thebeautymarts within 72 hours and received by Thebeautymarts within ONE week. Thebeautymarts is not liable for damage or lost returns. The return procedure (for items allowed to be returned) shall be as follows:
- Contact Thebeautymarts immediately of your intention to return the items.
- Items must be undamaged, unopened and with all original packaging intact and in good condition. At Thebeautymarts sole discretion, we reserve the right to reject any returned items failing to meet any of these conditions. Items must be that originally purchased from Thebeautymarts and not be substituted or replaced.
- Post the items back to Thebeautymarts within 72 hours of receiving them.
- Immediately provide Thebeautymarts with a tracking number of the package.
- Thebeautymarts must receive the package within ONE week from date of postage.
- Thebeautymarts shall inspect the item for any damage, or opened.
- Thebeautymarts shall contact the Customer on the status of the return and provide a refund if applicable.
- All refunds are in the form of a cheque.
To assist you in selecting the right products, we offer sample purchases. Do contact us if you require sample purchases prior to purchasing in large quantities.
Unable to Fulfil Orders
In the event that your order cannot be fulfilled for whatever reasons, we reserve the right to offer you an alternative product or a full refund of the amount paid. Refunds will be made within two business days subject to clearance by the various financial institution providers. Thebeautymarts reserves the right to make a partial delivery of goods that are available and refund payment for goods that cannot be delivered.
Thebeautymarts is not liable for any losses or damaged arising from orders that we are unable to fulfill. Our liability is only limited to refunding the full payment made for the goods that cannot be delivered.
All refunds are in the form of a cheque.
Transfer of Rights
The transfer of rights for any good purchase shall only be effective when payment has been cleared. This is different from payment made. For example, it may take banks two days to clear cheques deposited.Unless otherwise agreed, Thebeautymarts shall process orders upon payment clearance.
Postage and Liability During Postage
Unless otherwise stated for the individual item, postage shall be charged to the Customer prior to check-out.
Thebeautymarts is only liable to the point the items are posted. Thebeautymarts shall NOT be liable or be responsible for packages lost. We are not liable for any theft or damage during postage / delivery. As an option, you may purchase insurance for delivery. Please drop us a note if you wish to take up this option.
Our responsibility ceases one the package has been dropped off to the courier service, similar FOB terms as per INCOTERMS 2000. Again, we are not responsible for failure to deliver due to incorrect address, no one to accept the shipment or delays due to whatsoever reasons.
If items are returned to us due to failure to deliver for whatsoever reasons, Thebeautymarts reserves the right to further invoice and collect payment to cover the cost of resending the items.
Returned items that are uncollected for the next 30 days shall be disposed of the sole discretion of Thebeautymarts with NO refunds to the purchaser / customer.

Changes to the Terms
Thebeautymarts reserves the right to modify these Terms from time to time at our sole discretion and without any notice. Changes to our Terms become effective on the date they are posted and your continued use of Our Website after any changes to Terms will signify your agreement to be bound by them.
Jurisdiction
You expressly understand and agree to submit to the personal and exclusive jurisdiction of the courts of the country, state, province or territory determined solely by Thebeautymarts to resolve any legal matter arising from this agreement or related to your use of Thebeautymarts. If the court of law having jurisdiction, rules that any provision of the agreement is invalid, then that provision will be removed from the Terms and the remaining Terms will continue to be valid.
